Abstracts : Nonprofits organizations and commercial firms : a complex and ambiguous relationship.
To understand the relationship between non-profits organizations and commercial firms, it is necessary to abandon certain preconceptions to imagine a range of situations, far from bipolarity.
The article is based on the notion of economic activity, which needs to be distinguished from a profit objective-associated with the appropriation of profits-and which provides a common legal framework that allows an economic complementarity. A non-profit organization can be a tool for development, for example by pooling financial resources or supporting enterprise creation, or it can resort to subsidiarization by externalizing a part of its activities through a commercial company.
In view of the risk of degeneration, the author shows in particular that compulsory contacts would be a solution. The partnership can also center on promoting general-interest activities through sponsorship or creating a non-profit organization or foundation by the enterprise. Here, too, the article stresses the need for vigilance due to the risk of the non-profit organization becoming a mere instrument at the service of the enterprise’s « civic function ».
